NJDEP Proposed Modifications to Stormwater Management Rules Advisory

24 January 2019

The New Jersey Department of Environmental Protection (NJDEP) published proposed modifications to the current Stormwater Management Rules (NJAC 7:8) in the New Jersey Register on December 3, 2018. A courtesy copy is available here. It is expected that modifications to the rules will be adopted within one year of the public notice of this proposal, December 3, 2019.

Van Note-Harvey Associates (VNHA) has been following this rulemaking action and participating in the development of the rule proposal through Stakeholder meetings. Generally, NJDEP proposes to amend the rules to provide clarifications and eliminate the need to interpret “the maximum extent practicable” on a case-by-case basis when applying nonstructural stormwater management strategies by introducing a new standard, Green Infrastructure.

Other significant impacts of the proposed rule changes can be found in the “Definitions” section of the rules (e.g. NJDEP expands the applicability of “Major Development”), implementation of new design standards, and additional administrative requirements.

In our “Advisory Bulletin” (available here), VNHA highlights proposed modifications that may be of interest to you in the management of your facility, current and upcoming projects.
